A Miranda warning doesn’t really do anything in this situation. He’s carrying the evidence of a police battle inside him and it doesn’t really matter if he blurts out every little detail. The police know full well when it’s to their advantage to withhold it.

I understand the concept of the exception here (and it’s several decades old), and the idea doesn’t bother me. I’m just not sure it’s relevant here since there’s no indication there was a broader conspiracy or more bombs. There could be, but there’s no evidence at this point. It seems like an extreme overabundance of caution to me and I don’t want to see it screw up his trial. That said, Tsarnaev isn’t talking now anyway. Gov. Patrick says he appears to be in no shape to communicate and I wouldn’t be surprised if he were in a medically induced coma.
It was reported that one or more bombs were tossed at the police during the big chase/shootout, that Black Cap was wearing some sort of explosive vest, and that more bombs and bomb-making materials had been recovered. That sounds like an “indication” to me.
It is perfectly reasonable to me for the coppers to ask whether the duo left any other bombs lying around waiting to explode.
They found a bunch of other devices in Cambridge and Watertown and we know how thoroughly they swept the area. The younger brother also had no explosives on him when he was arrested. Basically it sounds like they threw another pressure cooker bomb and some homemade grenades at police during the gunfight. One brother was shot to death, the other was shot and ran away, hid in a backyard for a time, and then later dragged himself to hide in the boat and probably passed out from blood loss. Yes, it’s reasonable to ask if there is still any other stuff out there - although they still haven’t done that because he can’t answer their questions right now - but the police and investigators are not giving any indication they think there are other devices or dangerous accomplices out there. Everything they have said and done suggests they think the emergency is over. To that end I think they may be going too far in a just-in-case type of situation, and I don’t want to see that screw up his trial.
I’m very disappointed that McCain is supporting enemy combatant status. He was one of the most outraged voices against VP Cheney’s enhanced interrogation techniques.
This isn’t some guy we dragged of a far away battlefield. He’s an American citizen. Went to a well known Boston high school. Student at Dartmouth. He deserves the same treatment as any other citizen that committed a crime.
This kid isn’t hardened like the men we fought in Afghanistan. He’s not even a street kid. The pics I’ve seen indicate he’s pretty much a yuppie middle class kid. You don’t need cattle prods and pliers to question him.
How confident should we be that these two brothers were the only ones involved?
I haven’t read your linked article, but that does sound like an asshole move on McCain’s part. My impression is that the older he gets the more he idealizes his time in North Vietnam.

So this douchebag was freaking PARTYING with his pals on Thursday night while the manhunt was going on…after his brother had been killed? And the whole time his friends were looking at the TV going “wow man, that could be you!”.
Unbelievable.

Thursday afternoon is when they released the video of him. He went out partying with his friends on Wednesday. Thursday night he went to 7/11 with his brother where they were identified. He was wounded during that battle which is why there was blood leading to his hiding place where he was found Friday evening.
