I really think that Mr. DeLay has a firm understanding of the constitution. With that firm understanding comes the realization that laws against gay marriage will not stand up to that constitution.
He’s laying the groundwork for an amendment push or future public opinion. This never had anything to do with Schiavo.
I think it’s pretty clear that DeLay is saying or doing anything, to the point of appearing to be a scumsucking turdweasel, in order to distract the public from the fact that he’s a corrupt scumsucking turdweasel.
It seems to me there are at least three ways of answering your question:
Did the Supreme Court rule in 1950 that these laws were unconstitutional? No.
Would the Supreme Court have ruled in 1950 that these laws were unconstitutional? No.
Should the Supreme Court have ruled in 1950 that these laws were unconstitutional? Yes.
Which of these three questions most closely approximates what you mean by asking whether the laws were unconstitutional? If none of them do, can you elaborate on what you mean by that question? It seems to me that, until the constitutionality of a law is tested, the law is Schrodinger’s Cat: we don’t know its status until the lid’s opened.
Great post Gangster. At first I started to laugh at the last line, until I remembered that is exactly where it seems that DeLay (bloody hypocrite) and others of his ilk want to take our nation. Then I started to cry. I hope for all of our sakes that he rapidly goes the way of the Newt.
I’d be interested in seeing some, as when I did my research a while back, I had a rather difficult time finding any laws that would have prevented gay marriage that far back. I’d bet there were a couple, but the laws I found didn’t refer to the gender of the spouses as a requirement, much to the chagrin of those who argued against gay marriage because they didn’t want to change the laws.

Some have suggested that the GOP will try to throw Delay overboard in an attempt to distance themselves from unpopular business of late, particularly Terri Schiavo but not excluding such things as the Social Security scheme. They’ll try to look like they’re throwing out the problem child and setting off in a new direction, as they continue to support the same ends a little less vocally.
It would be great for those on the left if Delay went back to the bug business, but I hope Democratic leaders are wise enough to not let the GOP score points off of it.
Out of curiosity, do you have an opinion as to whether Tom DeLay is an ethical man or not? It would be neat to read something that’s topical to the OP before we dive into legal semantics.
