I’d actually argue that justice requires not taking that into account. The only thing about his life that is relevant is what led to him blocking the guy in. Did he do it to hurt him? Did he freeze up? Did he not think about the guy? That stuff is relevant. How badly you will wind up being punished is not.
Justice is not justice if you don’t punish someone as severely because you like them or feel sorry for them. As long as the law is just, punishment should be doled out impartially.
And while I think the guy possibly should have moved on through slowly, there’s no way I would have. I think I would have frozen up.
