It’s not clear from the video, but it looks like the cyclist became complicit in the violence even if that was not his original intention. And one of the reasons not commit crimes of any kind is that you get locked up with murderers, mother rapists, and father rapists. Even for as minor an offense as littering.

What we know about the personal life and history of the biker is IMO irrelevant to whatever charges should be made against him by prosecutors. It is more appropriate to consider these when determining what punishment there will be – assuming a charge and conviction.

I’d actually argue that justice requires not taking that into account. The only thing about his life that is relevant is what led to him blocking the guy in. Did he do it to hurt him? Did he freeze up? Did he not think about the guy? That stuff is relevant. How badly you will wind up being punished is not.

Justice is not justice if you don’t punish someone as severely because you like them or feel sorry for them. As long as the law is just, punishment should be doled out impartially.

And while I think the guy possibly should have moved on through slowly, there’s no way I would have. I think I would have frozen up.
