Instead of driving them back into the closet, drive them back under a rock.

Harvard was a defendant in the recent decision. AIUI, since they accept students who use Federal grants and loans, they are subject to Federal rules.

Of course, I’ve seen estimates that the Harvard endowment is large enough that they don’t actually need to charge tuition, so presumably they could make it free and then accept whoever they want, based on whatever criteria they choose.

But Harvard might just possibly be influenced by alumni donations?

Harvard is now being sued over legacy admissions. Gee, I wonder if the Supremes will strike them down as impermissible?

Three minority advocacy groups are suing Harvard University’s governing body, accusing the school of discrimination by giving preferential treatment to children of wealthy donors and alumni, and are citing the recent US Supreme Court ruling that gutted affirmative action to bolster their lawsuit.

The lawsuit, filed by the Lawyers for Civil Rights group on behalf of the Chica Project, the African Community Economic Development of New England, and the Greater Boston Latino Network, alleges the students who receive that preferential treatment are “overwhelmingly White,” and make up as much as 15% of admitted students.

“This preferential treatment has nothing to do with an applicant’s merit. Instead, it is an unfair and unearned benefit that is conferred solely based on the family that the applicant is born into,” Lawyers for Civil Rights said in a news release. “This custom, pattern, and practice is exclusionary and discriminatory. It severely disadvantages and harms applicants of color.”

I predicted this:

Oh, I’m sure this SCOTUS will find a way to say that legacy admissions are just fine and dandy.

Yep, it’s the “But what if we didn’t?” defense. Logical consistency not just no longer needed, it’s no longer wanted. They’ll make the decisions they want to make, in order to support their agenda, and care not a whit that they’ve established contradictory precedents.

Ayup. They’ve already make it crystal clear that precedent and judicial consistency mean nothing to them.

I would not be surprised if the Court decided that “Rich Person” is a protected class.

They have.

And the scariest thing about this to me is, many people don’t even realize how dangerous it is.

I liken it to a boat’s rudder, where the mechanism that holds the rudder steady, breaks. The rudder is then free to swing wildly around – and we have lost our way in a big, deep ocean.

They don’t care, but they should, because setting precedent is almost all of the Supreme Court’s power. If they set a precedent that precedent is meaningless, then they end up with power only over those specific cases that end up in their courtroom.

But that’s a tomorrow problem, like climate change, or appointing Supreme Court justices in the final month before an election.

What mixed precedents do in the meantime is the same thing that Trump’s multifaceted lies do: they give the deplorables a set of tools that lets them allow or deny anything.

Are you deciding a case involving benefits for minorities? Sorry, the Harvard decision says that’s illegal. Are you deciding a case involving privileges for rich people? Sorry, the College X decision says that’s okay.

And when you appeal to the supreme court, they just refuse to hear your case, “It’s settled law”.

I thought that — well before the latest round of Supreme Court decisions — the idea was already that race-based discrimination can be easily struck down, and discrimination based on stuff other than race (or sex or religion, or other entries on a pretty short list) got a lot more latitude on being allowable.
