(Old) Looking ahead in the MMP

A somewhat more productive day today. It’s been drizzly again, started out with mid 50Ferrets and topped out at 63F. I tried to make the most of it.

Try not to think about how old it is. Just enjoy it for what it is. :slight_smile:

52, I’ve watched The Gilded Age and look forward to the new season. It’s worth a watch for all the excellent actors and the costuming. It’s over the top (as you might expect), but if you enjoyed Downton Abbey, I’m pretty sure you’ll enjoy The Gilded Age, too. But it’s a high(ish) class soap opera, let’s be honest. :wink:

So as I said, I made better use of my time today. I got out early and picked apples, then caught up on the berry-picking while I was at it. Came in, tidied the house, did some laundry, balanced the spa chemicals, had a long play session with Ollie and then did personal administrivia till that was caught up. Had a repeat breakfast of yesterday with plans for a repeat dinner, too. So I felt a bit more useful today, which was nice.

The second scary domestic court story, for those who were interested, blotted out for those who weren’t:

Summary of Another Day in Domestic Court

My judge at the time had a civil court assignment. We were free, so we had been assigned a contested hearing from the Domestic Court calendar to fill our time. We rarely did them.

Contested hearings are like court trials. This one had a time estimate of about 2 hours. The parties and their lawyers are the only folks in the courtroom, along with court staff and casual observers. In this case, both halves of the estranged couple were paralegals, so they were representing themselves. It was a quiet day in the courthouse, a Friday afternoon if I recall, and no one was in our courtroom except court staff and the 2 parties. My bailiff at the time was an older fellow who was permanently farmed out to Court Services as a way to keep him in a job he was still mostly capable of doing until he retired. A very nice man, but not someone you’d be eager to have out on patrol with you.

The case itself was extremely sad to me. There’s an inexpensive way for parties to conclude a quick dissolution of their marriage if they agree to how they want to handle issues of child custody, property division, payment of child and spousal support, etc., and more importantly, if they can completely trust each other. It’s called taking a default, and it’s how my ex and I handled our divorce. In brief, the process is this: One party files as the Petitioner. The other party must file as the Respondent, and they must do so within 30 days. If they fail to file a response in the allowed time, then the Petitioner can take the Respondent’s default. And what that means is, the Petitioner will get everything they ask for, no questions asked.

When you do this procedure as a cooperating couple, you simply file your Marital Settlement Agreement outlining your agreed-upon terms with the court and obtain a final judgment of dissolution. Bing, bang, boom, done. No lawyers, no huge expense except filing fees. That’s what my ex and I did.

But in this case, the Petitioner took her ex’s default – and then she fucked him. She awarded herself sole custody of their daughter, generous spousal and child support. Not what they had orally agreed to. What we were hearing that day was the Respondent’s motion to have that default set aside.

Unfortunately, the elements that allow a court to set aside a default are extremely narrow. Things like, did he have notice of the proceeding, was he properly served, etc. If those elements were met, the court had no discretion to do anything other than deny the motion. As we heard the case, it was obvious that those elements had all been met.

The judge I was working for never liked to rule from the bench, which I hated. It meant I was going to have to prepare and serve notices of his rulings – even though in this case, we both already knew all he had to do was utter one single word, “Denied,” in open court, and that would be the end of it. Lots of extra work for me. Tsk!

During the hearing, the Respondent was very agitated. He had a briefcase with him that he kept opening and closing, and it was clear he was distraught. Our old bailiff never took a stroll over to have a look in that briefcase, so we’ll never know for sure what was in there.

At the end of the hearing, the judge ordered the matter to stand submitted. Once we locked the courtroom doors, the judge poked his head back into the courtroom where I was working and said the magic word, “Denied.” I immediately prepared my notices and got them in the outgoing mail. I saw the parties’ addresses were out of our area. I guess they had moved after they filed for their dissolution.

The following Monday, there was a story in the local paper. It reported that immediately upon receiving the notice of the judge’s ruling, the Respondent had hopped in his car, gone to the home of his ex and shot both her and their daughter dead before turning the gun on himself.

I never argued with that judge again over ordering any domestic case to stand submitted to await his ruling. And no hearing or trial I ever participated in ever frightened me more than this one. Domestic Court is a dangerous place.

The family reunion I went to today didn’t have great attendance but there was an excuse. See, this thing started in 1960 and families have shrunk because fewer kids, and the older generation passing. My folks used to be the second generation and all but four of that cousin group are gone. And tomorrow there will be a funeral of another of those cousins so they weren’t here today. We will all see them tomorrow though. It was still a good time and I had to hurry to get a small piece of the chocolate cream pie I made as it got snarfed up. I even heard a joke, with someone saying if they had been at home with the pie tin they would have licked it. Still, lots of good food and I won’t eat anything else tonight because my blood sugar climbed. It was worth it.

My sister, being the family genealogist, had all the photo albums and had printed off a new copy of the family tree. For several years she had brought it to spread out on a table, and encouraged folks to make changes or additions, this time she put a picture by each name that she had a photo for. I love the picture of my materal grandmother, it was her high school graduation pic. She had small buns on either side of her head and the first time I saw it I joked “Princess Leia!”

So tomorrow I will see a number of those we missed today as my sister and I will be attending the funeral. The woman was a cousin of my mother. The grandparents of my mother had recently passed in 1960 and their three sons were sort of the heads of the different branches. When my aunt passes, she being my mother’s younger sister, it freaks me out to realize I myself will be the oldest in this branch, followed closely by a cousin who is about seven weeks younger than I am.

What kind of berries? I love berry picking, or any fruit. I am sad that two nearby huge mulberry trees have been taken down. I would make pies or icecream. The latter was a gorgeous purple color.

Blackberries. They are a noxious weed here and they grow everywhere. But the fruit is luscious, so I have a few unbothered patches around this place. I tear up old clothes and scratch up my arms every year to harvest them. There used to also be wild black cap raspberries, but those got competed out, sadly. They were so flavorful!

I have a neighbor who has an abandoned pickup truck in a side yard. Over the years, I’ve watched as the blackberries have grown over it to the point you can no longer see the truck.

I’m sorry you lost your mulberries!

I managed to resist checking on the office fish today. It was difficult. The weather helped.

There was an early morning flash flood alert that had my phone blaring. I looked outside and pouring was an understatement. Decided to be a fair weather church goer and went back to sleep.

Things cleared up finally and the sun came out for a bit.

The home tank has changed dynamics a bit. Shiro is looking around for those pesky pepper corydoras. Hopefully they are having a nice quiet, settling in day at the office. The Pygmy corydoras are flitting around the tank and shiro is ignoring them. I guess the peppers were too big and shiro thought they were a threat to him.

Good evening all. Mowage has been completed, 4 big bags of clippings are awaiting pickup tomorrow. Expect I will be abed relatively early, between gym and mowing I had a fairly active day. Tomorrow should be quieter, just the usual shop-n-sammich run early, but then the shots will be administered on Tuesday, so I have that too look forward too…

Pilot, I have been lucky enough in my life (and having a good buddy who arranges travel like this for a group of us) to have done the Galapagos twice in ships like yours, it is a remarkable place to visit, isn’t it?

Bright Tree, I’ve learned to tolerate my kidney/bladder output and as long as the overall flow isn’t too excessive I’m not going to worry unduly about it. Drinking as much diet soda as I do probably contributes to it, but one must have at least a couple bad habits… Sounds like a nice day was had, but that story…you have to wonder if you quite literally dodged a bullet there…

Cupcake, my family reunion is pretty much me visiting Brother and his family at Thanksgiving and Xmas, we have pretty much outlived or lost contact with the rest of both Mom and Dad’s families, so just us now.

That’s the hope. All day, I wondered why there wasn’t the scent of Coq au Vin permeating the house. I was in the middle of plating dinner[1] and I went to pick up the insert. It was rather cool. I looked at the outlet, and it was conspicuously empty. I was rather pissed at myself.

Mrs Magill ordered a Margarita Pizza, and saved the evening.

I’m still kicking myself.

The problem with mulberries is that they ripen gradually, not all the fruit more or less together. You have to go out each day to pick, and get maybe a quart a day, or even less. One berry will be ripe just beside one that is green. I have a friend whose mom lived in the old family home and they had an unusual mulberry tree. Most of the trees are at most average size, but when I first saw this tree I didn’t recognize it as a mulberry the trunk was so huge. It took more than two people to get their arms around it and most of the branches were so far up you couldn’t reach them standing on the ground.

Up, caffeinated, and sheveled. Off to heave. It’s currently 73 degrees Ferret Height(22.773 Centipedes)

My evil dad often told me my room looked like a pigsty, but he never told me what kind of tie a pig wears. My searchy thingy says numptie, or numpty, is a Scots word for fool. I can feel for that. I’ve lost count of all the foolish things I’ve said and done. My brain likes to drag them out of the dusty cellars of the past and whack me over the head with them. That’s a nasty habit, and I wish I could break it.

Our favorite handyman will be dropping by this morning to give us an estimate on a list of things we need done.

We watched the last part of The Sheep Detectives last night. Very good flick. Rambunctious at times.

When I hear that phrase, I always picture a guy selling hot chocolate out of a truck.
