I don’t think this would change anything. Even if this happened to some Republican legislator, and his or her heart grew three sizes that day, and he or she rose up to oppose this legislation, they would just find themselves ejected from office at their next primary. These legislators are simply reflecting the preferences of the conservative voters in their gerrymandered districts.
Which leads to my strategy. The list of all the people who voted in the last Texas Republican primary is freely available from the Secretary of State’s office, including their name, date of birth and physical address. Take a lesson from the SovCits. Get teams of lawyers to work filing masses of lawsuits against all of them. Issue subpoenas for them to testify. Register liens on their houses. Clog up the state court system so that those with other cases can’t be heard. The legislation even protects such lawsuits from state laws designed to prevent frivolous lawsuits, so go nuts.
IANAL, but it’s my understanding that the extremely devilish nature of this new anti-abortion law lies in the fact that it’s a law that would be enforced by civil and not criminal penalties, therefore it’s more difficult to claim that your constitutional right to an abortion is being abridged because the enforcers are private citizens, not government officials (in addition to the fact that it would be like whack-a-mole to figure out who to bring suit against to claim your constitutional rights have been violated).
But why is it potentially NOT considered a violation of your (general you) rights just because private citizens are the ones bringing suit against you in civil court? The yahoos who are interested in suing anyone they claim “aided and abetted” an abortion after 6 weeks may not be government officials, but the ones who PASSED the law in the first place sure were. And I’m assuming it will be Texas state judges presiding over any of these civil cases that may be brought.
WHAT THE FUCK? I have no other coherent words as I am so beyond angry. The US Supreme Court can go fuck itself. Oh, and also fuck Texas, not reluctantly.
This new Texas anti-abortion law isn’t intended to stand up in court. It’s going to collapse as soon as anyone puts any sort of stress test on it. No, it’s intended strictly as a chilling effect- it exists to threaten abortion providers into shutting down.
Ken Paxton, Texas’ indicted felon of an AG, opens his lying pie hole:
A woman in the crowd asked Paxton how many Republican governors “are willing to stand up and proclaim that Trump did win the 2020 election? We have evidence.”
“We’re sick of the overthrow,” she said. “This has been an overthrow, and we expect actually all of you to stand up and proclaim this. With 50 Republican senators, well at least maybe 40 of them, it’s time to do that, take the bull by the horn. We won, we know that. This is an overthrow.”
“So, let me just say that I agree with you,” Paxton responded.
In case you don’t know what the endgame is, remember, these guys put their evil plots in writing.
But don’t worry, the I heard a rumor DOJ might be pondering the idea of having a discussion about the possibility of considering maybe talking about doing something. And I’m sure Congress may issue a scathing report that no will read by 2025 or so.
Sounds like the kind of committee you create to keep the children occupied while the adults are trying to work. Not that there are many adults in Texas government.
Lordy, Lordy – Rep. Louie Gohmert is apparently rolling out a primary challenge to Texas Attorney General Ken Paxton. My favorite quote from the article: "The more recent website says Gohmert ‘needs 100,000 citizens to send $100 each (or any other amount to get to $1,000,000) by November 19.’ However, the product of 100,000 and $100 is $10 million, not $1 million.
