I just recently retained one, thank God he’s willing to let me pay him later. I can’t afford one now as i’ve lost my last 3 jobs in the past 4 months because he keeps finding me, so back to job hunting again. He’s ruining me in every way possible.
I have a friend in a similar situation with a soon to be ex. Her attorney told her to document everything. Get a binder and write down chronologically what has transpired to date, then from here on, document, document, document. Print out every text message & save any voicemails he has sent you in the past. The courts know his type…
I could be wrong but I don’t think a RO hearing involves “cross-examination.” I think you present your side and the defendant presents his side. Then the judge rules.
Talk to your lawyer, or find a victim’s advocacy group.
I was told by my lawyer that he has the right to have me cross examined on my affidavit before he submits his statement of defence.
Then it is what you must endure in order to get get an RO. An RO can only help you defend against his baseless lawsuit. In fact, it may be sufficient to get a summary judgment in your favor.
I don’t have much to add to this discussion, except I think you should see this through … you’ve been wronged and We the People want this to be corrected … and there’s many others out there who will benefit if you get this creep locked up …
It’s good you found a lawyer willing to help you without money up front … these people have a nasty reputation as a group, but individually there’s some real gems … sounds like you found one !!!
I’m not being snarky here … I’m serious … what are the open carry laws in your locale? … nothing more terrifying than a hysterical woman with a .38 on her hip … now, you’re just trying to scare the creep … don’t actually shoot him … check with your lawyer about using blanks in the gun, I’m sure he’ll tell you exact what is lawful, what is unlawful, and what maybe a jury might think …
I think you’ve made one of those MAJOR SMART MOVES by contacting the courts first … DA’s look at that, and they like it … if something gets weird, you’re going to look good by doing the right thing first …
That doesn’t make any sense. I’ve never heard of serving a third party and having it be valid. What state is this?
Why would they say to let it expire? At the time there was no other choice since you were unwilling to testify at the final hearing but I don’t know why they would advise to drop it.
Was this a former dating relationship? In many states the laws are very different it it was domestic violence as opposed to some random guy who fixated on you.
They suggested I let the RO expire because my stalker kept fighting against it and i could only get 2 week extensions at a time which left me with a $4000 lawyer bill, I couldn’t afford it anymore … you would think he would just take the damn RO and leave me along, for him it would be better than taking it to the next level and having criminal harassment charges… but he just wants to keep fighting it and draining me financially so i had to eventually give up let it expire… then the harassment continued of course with the lawsuit now.
so my stalkers lawyer has decided to write my lawyer telling him they dont need a statement of defence and that maybe we can come to an informal agreement… now i see this lawsuit was just used as a scare tactic, to drain me financially and continue the bullying… i was advised by friends that i should still submit a statement of defence to have it on record… knowing this narcissistic psychopath will demand money and gifts back and god knows what else which he knows i will refuse, then he will say ok then lets go to court… when will this nightmare be over! at this point he’s gas lighting me … how the hell do you win against psychos like this that have money and power?!
