I was under the impression you had to get permission to use copyrighted materials. If I wanted to include a lengthy quote (more than “fair use” can justify) from a Leon Uris novel, and his estate agent says no, then I can’t. They not only can insist on money for it, but can deny the application entirely.

My understanding is that many public venues pay licensing fees to organizations such as ASCAP, which allows them to play any songs that ASCAP (or similar organization) has control of. ASCAP somehow knows how much each song is played and pays out to the artist.
