I don’t understand this. The phrase “against nature” is mentioned once in this bill and so there doesn’t seem to be a statutory definition of what acts constitute “the abominable and detestable crime against nature”
The bill also makes no mention of anal, oral, or sodomy. So can someone help me understand where it’s referenced that sodomy is now outlawed?

I liked the phrase “sexually delinquent person” in the law. It sounds like someone who is behind on their installment plan or something. “Well, you are required to have sex by the first of the month, but according to our records, you’re delinquent.” I mean, first I’m delinquent, and now I can’t even rectify that with some sodomy, ferchrissake?! Come on, throw me a bone, here.
Typically, legislatures were too squeamish in Ye Olden Days to actually mention sex acts when outlawing them. The “detestable crime against nature” is a fairly well-established, if not well-defined, common law term of art that (probably) covers bestiality, buggery and oral.

I looked in Chapter 750 of Michigan’s statutes (Michigan Penal Code), which is what is being amended for the four sections in this bill. Now, the title of 750.158 is “Crime against nature or sodomy; penalty” so that’s where I think these reporters are coming from.
But there’s no statutory definition of “sodomy” anywhere in the MI penal code. The law itself (750.158) doesn’t even have the word sodomy in it! So I would argue that, when you take the title into account, sodomy is a separate act from a “crime against nature” and one that still isn’t punishable.
So hell, maybe Senator Rick Jones is actually trying to outlaw sodomy because he hates blow jobs so so much. I dunno. Never talked to the guy. But I would say that if that truly was his goal, he failed. And if that wasn’t his goal, we’re making a mountain out of a molehill.
Oh and 750.159 is hilariously titled “Emission need not be proved” Take that, you pig fuckers!
