He was at David Fry’s detention hearing and said that a woman handed it to Fry’s attorney two minutes before court. He saw her the next day at the Portland rally and asked for a copy. The prosecutors are intentionally making this an expensive fight and are adding to the costs as much as they can.

Would have been cheaper to pay the grazing fees.

A superseding indictment may be coming out tomorrow. There is a hearing Wednesday on whether to rule the case as “complex” which would nullify the right to a speedy trial (currently set to start next month). This should be a no-brainer. It seems likely they’ll issue at least some new indictments before that hearing.

At the hearing, they are also set to discuss the government’s motion to put a protective order on all the evidence, which they estimate at 1 terabyte. The PO would keep it from being released publicly. This may be a dig at the Arnold Law Firm’s habit of holding press conferences working social media to, some would say, taint the jury pool.

I didn’t click the links in that PDF but I did manage to wade thru the whole thing, though it’d be fair to say that parts of it were merely skimmed rather than given my full attention.

I am very glad that I’m not a Judge who is going to have to actually give that thing serious consideration so as to refute it.

What I find particularly bizarre are the attempts by the Bundy supporters to disgrace the memory of Finicum (by what presumably are their own standards). They claim that Finicum, even though he made a point of always being armed, was so stupid to go someplace where a confrontation with law officers might be expected completely unarmed. They claim that, although Finicum said he would never be taken alive, made a cowardly attempt to surrender. They seem to have no respect at all for the man. If what they say about the final confrontation is true, they make him out to be a liar, a fool, and a coward. They have no shame.

I gotta say, the guy was nutty enough in his beliefs it wouldn’t surprise me if he had been unarmed and had tried suicide by cop, hoping to be a martyr and rally people to the cause. But the money’s on him having a gun and trying to draw it.

Does it even matter whether he was armed? His reputation was well-established. He stated more than once that he was going to shoot it out. To die ahead of capture. The fact that he reached toward his pocket after raising his hands, and was already known to be hostile, makes the question of whether he had a gun on him entirely moot.
