More proof that we/the constitution relied way too much on convention and tradition without actual rules or laws. I suppose these were trump appointees or republicans in general who made this ruling? So I guess now Congress’ hands are tied forever. They’re supposed to be a check on the executive but now they can’t be.

It’s a very common source of misunderstandings between US-based and abroad-based branches of the same company, as well as for Americans themselves; both the stuff which is based on precedent (no official law or regulation) and the stuff which is on the book but does not apply (there is a law or regulation but due to precedent you’re not supposed to apply it).

Lately for some reason I’ve been remembering a lot a coworker being completely confused by how to find out legal information in Spain. We explained that since laws are mainly built top-to-bottom, getting more detail as you get to a lower level, and a law can never contradict another one, you search bottom-up: is there a regulation at the local level? If “yes”, apply it (it will include any upper-level laws which may exist); if “no”, search at the regional level, and so forth. He was super confused “but what else?” and we were super confused by his confusion.

THE FACTS: Trump’s denial of nearly 3,000 deaths is baseless, however imprecise estimated death tolls can be from a disaster.

Independent researchers at George Washington University estimated 2,975 excess deaths related to Hurricane Maria in the six months following the hurricane, which hit last September. Puerto Rico Gov. Ricardo Rossello commissioned the study and accepted the death toll as the best available. Rossello rejected the findings of a different study that estimated more than 4,000 died, saying he found the GWU research with its lower number to be scientifically sound.

A federal judge has ruled that Ken Cuccinelli was unlawfully appointed to lead the U.S. Citizenship and Immigration Services agency and, as a result, lacked authority to give asylum seekers less time to prepare for initial screening interviews.

Cuccinelli, a former Virginia attorney general and an immigration hardliner, was named to a new position of “principal deputy director” in June, which immediately made him acting director because Lee Francis Cissna had just resigned. The agency grants green cards and other visas and also oversees asylum officers.

U.S. District Judge Randolph Moss in Washington found Cuccinelli’s appointment violated the Federal Vacancies Reform Act, a 1998 law governing who is eligible to lead federal agencies in an acting capacity. The impact of the ruling wasn’t immediately clear.
