Federal prosecutors in U.S. Attorney Jeanine Pirro’s office are dropping a criminal probe into whether former President Joe Biden and his aides unlawfully used an autopen to issue pardons, a person briefed on the matter told CBS News.
Two sources confirmed the existence of the probe, with one telling CBS News that the matter has since been closed because prosecutors were never able to find a legal hook to be able to pursue the matter further . CBS News has not determined precisely when the case ended.

Washington — The Senate defeated a war powers resolution that sought to block President Trump from using further military force against Iran , rejecting a Democratic push to rebuke the president amid the administration’s shifting justifications for the war and warnings about more American casualties to come.
In a 47 to 53 vote, the resolution fell short of the simple majority it needed to advance. With Democratic Sen. John Fetterman of Pennsylvania voting against the measure, it needed the support of at least five Republicans. Only GOP Sen. Rand Paul of Kentucky supported it.
It’s the second time in less than a year that Democratic Sen. Tim Kaine of Virginia forced a vote on a war powers resolution related to Iran. The upper chamber voted down a similar effort in June 2025, after the U.S. bombed three Iranian nuclear sites.
Kaine’s resolution , which was cosponsored by Paul, would “direct the removal of United States Armed Forces from hostilities within or against the Islamic Republic of Iran that have not been authorized by Congress.”
Though the war powers vote was expected ahead of the strikes on Iran over the weekend, the massive military operation that began Saturday upped the stakes — and added to the urgency.
“They have shifting goals, different goals all the time, different answers every day. And I am truly worried about mission creep,” Senate Minority Leader Chuck Schumer, a New York Democrat, said Tuesday.

The Republican-led House Oversight Committee voted Wednesday to subpoena Attorney General Pam Bondi for testimony on the department’s handling of records related to Jeffrey Epstein .
The motion to subpoena Bondi passed by a vote of 24-19. Five Republicans voted for it, including Nancy Mace of South Carolina, who put the motion forward. The Republicans voting with Mace and the Democrats were: Tim Burchett of Tennessee, Lauren Boebert of Colorado, Michael Cloud of Texas and Scott Perry of Pennsylvania.
The Justice Department did not immediately respond to a request for comment.
The department acknowledged Wednesday that tens of thousands of Epstein files are “offline” as it deals with redaction and privacy issues that it hopes to have addressed by the end of the week.

A separate federal panel, the U.S. Commission of Fine Arts, approved the project at its February meeting.
“Everything here feels inflated,” said Parker, who has been an architect for more than 35 years. “The net effect of this is to adversely impact what is the most important historic — the most identifiable historic — house in the entire United States. This is permanent, what it will do to the White House.”
