(2) with intent to cause the overthrow or destruction of lawful civil authority, creates, in concert with any other person, revolt, violence, or other disturbance against that authority is guilty of sedition;
(3) fails to do his utmost to prevent and suppress a mutiny or sedition being committed in his presence, or fails to take all reasonable means to inform his superior commissioned officer or[ commanding officer of a mutiny or sedition which he knows or has reason to believe is taking place, is guilty of a failure to suppress or report a mutiny or sedition.
(b) A person who is found guilty of attempted mutiny, mutiny, sedition, or failure to suppress or report a mutiny or sedition shall be punished by death or such other punishment as a court-martial may direct.
How about Dishonorable Discharge, which would include (I hope) a warning to never ever call themselves a Marine, wear the uniform, or attend any service oriented ceremony.
Hell, go 19th century on them. Stand them in the parade deck and rip the rank, awards and EGAs off their kit and (if officers) break their Mamlukes in half.
Just reading the wiki article on Leavenworth’s United States Disciplinary Barracks, all the mentioned prisoners committed crimes either on a US base or while deployed, which is maybe where the line lies where JAG would pay attention. I guess?
For practical purposes, yes. I mean your off duty civilian crime really was against The People not against The Service so The People can deal with you, if it is bad enough, as mentioned, you can always get given the Bad Kicking Out and you stop being “our problem.” That is the usual course of action on US soil.
Now, if they conspired to do this while on post or used the service’s communications resources… that could be a way to get to it.
If that’s the case, I have to say I’m tired of the Leavenworth jokes when these mil jerks have no chance of military prosecution for J6. If the civvy courts do their jobs, that’s fine with me.
The only discharge I want to see on these traitors are from M-1 Garands. Blindfold and cigarette optional.
The UCMJ, IIRC, has a line or two about “Prejudicial to Good Order and Discipline.” I kinda think Insurrection qualifies. Doesn’t say anything about being on base or on duty.

I hope they get pounded if convicted, regardless of the court. Members of the military of a democracy have to know there are lines you must not cross.
