The formula is “Time, Place and Manner” restrictions are ok within reason. You can’t carve your political manifesto into the Washington Monument with a chisel and claim 1st amendment protection when you get arrested for vandalism.

Yes, because they used prosecutorial discretion to not enforce the law against those January 6 marchers who stayed outside the building:
Except as provided in section 5106 of this title, a person may not—
(1)
parade, stand, or move in processions or assemblages in the Grounds; or
(2)
display in the Grounds a flag, banner, or device designed or adapted to bring into public notice a party, organization, or movement.
If you look at section 5106, you’ll see that the exception still does not allow first amendment activity on the grounds:
To allow the observance in the United States Capitol Grounds of occasions of national interest becoming the cognizance and entertainment of Congress, the President of the Senate and the Speaker of the House of Representatives concurrently may suspend any of the prohibitions contained in sections 5103 and 5104 . . .

Some more thoughts on this interview from a former NY defense attorney. This is usually the final step before a plea bargain, and indicates several hurdles have already been crossed. But with a lot of remaining questions.
Will it culminate in what is the last step of the process—a formal plea deal? If so, what would the deal be, and who would he be providing evidence against? Would the incriminating testimony cover only Jan. 6, or would it impact other potential crimes as well? Given that making a deal with federal prosecutors while ignoring Giuliani’s potential exposure in parallel events under investigation in Georgia would be malpractice, how, if at all, will a deal with DOJ also relate to Georgia? If Georgia is included, would Rudy also be a witness in that matter?

Initial report of DC Bar recommends that Guiliani be disbarred, based on his attempts to overturn the 2020 election without any evidence.
Now goes to the Bar’s Board of Professional Responsibility, and ultimately to the DC Court of Appeals.
The report says:
“The right to vote is the ‘essence of a democratic society.’ Respondent’s frivolous lawsuit attempted unjustifiably and without precedent to disenfranchise hundreds of thousands of Pennsylvania voters, and ultimately sought to undermine the results of the 2020 presidential election. He claimed massive election fraud but had no evidence of it,” the committee wrote in its report.
“By prosecuting that destructive case Mr. Giuliani, a sworn officer of the Court, forfeited his right to practice law. He should be disbarred.”
