My cite is the UN Charter which forbids any non-defensive assault on the sovereignty of another country. The UN Charter is a treaty ratified by Congress which means that the invasion of Iraq was illegal under both international and US law. Just because Bush hasn’t been indicted doesn’t mean that he didn’t violate the Charter.

Until someone attempts to indict President Bush, it is wishful thinking. Given the lack of action from his enemies, domestic and abroad, legally President Bush appears to have dotted his 't’s and crossed his 'i’s.

No. It just means that the International Community doesn’t have the will to enforce the charter against the US and that a partisan Republican Congress will never enforce the Constitution against their chimpanzee overlord.

I’ve seen that argument a lot with regards to the invasion of Iraq. I’m not sure why anybody thinks it’s valid but I’ve seen it raised quite often. By that logic smoking pot is legal. I’ve smoked pot. I didn’t get indicted for it. Therefore smoking pot is legal. I also go over the speed limit sometimes without getting a ticket. Therefore speeding is legal.

Maybe I’m wrong, but I don’t think it’s actually illegal to smoke pot. Selling it, yes. Possessing it, yes. But *smoking * it? I’ve never heard of anyone convicted on that one.

I wasn’t doing any such thing. I raised the Iraq war as part of a series of examples of a tu quoques as response to a thread that was itself a tu quoque. I was then asked for a cite that the invasion of Iraq was illegal and I provided one. It’s not my fault that the thread has gone in this direction. My original reference was pretty casual and part of a larger point.

Yeah, from other posts I figured there was a DeLay thread which I didn’t see which is being refferenced by the title of this one. My mistake.

This thread isn’t a tu quoque. This item has been all over the news for a the last few days, and it’s a legitimate, deserving Pitting. Had Shodan posted about this in the Delay thread, it would’ve been a tu quoque.

But I agree that other posters are at least as much to blame for the hijack, which is why I’m suggesting we not go there. I think Unclebeer had it exactly right in refusing to respond.

No, I’m saying that President Bush has lots of enemies who would like to hang him by his short and curlies; enemies with the means to mount such a challenge to his presidency. Perhaps they simply lack the will, or perhaps President Bush jumped through whatever hoops were necessary to prevent such an accusation. This isn’t a slam dunk, like OJ was (doh! :smack:). I’m certainly not going to argue the legal merits of either side of the case, because it would get into a level of minutiae far beyond my knowledge. It may, or it may not have, be an illegal war. IMNSHO, it’s an immoral one sold to the UN and the American people under false pretenses.
