I wouldn’t read too much into this – the Judge required Pence to respond to the suit by today and it looks like his objection is on technical grounds. It was silly of Gohmert et. al. to think that Pence was ever going to go along with a suit against himself.

If Pence resigns, then I assume that the President Pro Tem of the Senate would certify the votes. That office is held by Chuck Grassley, who has said he recognizes Biden’s electoral victory.

I guess I don’t see what Pence has to gain by resigning. He doesn’t need to fight Trump on it – he doesn’t even need to respond. He just keeps on being Vice President until January 20 and there’s nothing that Trump can do about it. Trump urged the Republican Governor of Georgia to resign a few days ago, and he just ignored it. The news cycle moved on.

Pelosi is not an officer of the senate, and wouldn’t “move up.” That would be a sideways move in this context.

Well, that’s pretty self-evident. I’m more concerned with what is he legally able to do. I know Trump appointed Pence to be his running mate, but he was also voted in independently by the Electoral College in states that Trump/Pence won. I’m not sure Trump can actually snap his fingers and make Pence go away.

Well it does, IF Pence resigns. But I am wrong, Pelosi doesnt move up: Section 2 . Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.
I guess if they cant agree in a speedy fashion, the yes the President pro tem of the Senate would step in.
