We got this thing in the Constitution about “cruel and unusual punishment.”
Technically, it is not “punishment” until after you are convicted. The police are allowed to be all kinds of ugly up to that point.
Firstly, there’s nothing in the 8th amendment that talks about conviction, guilty, or prisoner.
As to your second point, we have a whole thread bitching about ugly cops. What do you suppose would happen if we came across some poor schlub in a fetal position? “The cows… he kept talking about the cows.”

This has caused a number of ableist meltdowns even in the mainstream press, so you can imagine how the right wing outlets are handling it.
