Let’s start with that the article is just quoting commentators floating the idea that there may be such a lawsuit, basing themselves on other prior suits in other countries. But it contains no expression from Louboutin about this.
A suit would have to argue that this is creating confusion about the branding of the shoe or participation of the company in its production or marketing, or having a deleterious effect on the legit product’s market wouldn’t it?
To some extent. A lot of the time, it’s really about publicly showing one is taking active measures to protect one’s brand, which is a condition of maintaining a trademark.
If they didn’t take at least some action, even if of the ‘sternly worded letter’ or ‘public acknowledgement no reasonable person could confuse them’ variety, that can be taken as a sign they aren’t really maintaining their trademark and, if enough similar cases crop up, eventually to the argument they have abandoned their trademark.
It is easier/safer for them to at least make some noises about it, or at least that what their lawyers should be telling them.
