If the Daily Beast account is accurate, she would surely be vulnerable to a civil suit. Civil rights, though: wouldn’t that require the man she got arrested, James McIntyre, to be a member of a protected class?
I’m not seeing information on that; a Newsweek article appears to promise such but says nothing more about McIntyre than
IF Atamasama was proposing that McIntyre sue Mace for violating a supposed right to—what, shake her hand? speak to her?—then my comment about protected classes is irrelevant, yes. If the witnesses cited by Daily Beast are to be believed, the cause of action McIntyre might avail himself of would be, perhaps, false arrest. Again, no protected class would be relevant.
I was picturing McIntyre, IF a member of a protected class (by virtue, for example, his race or disability, if any), suing Mace on the basis that she permitted members of other groups to approach her and shake her hand without calling police—but when he approached and did the same, she called the police.
I’m still not seeing any updates on relevant facts that would aid this discussion, such as video of the encounter, information about McIntyre, statements made by the police about it, etc.
These statements are in the bullshit realm beyond the realm of binary truth for false.
Its like when the CEO of 7-11 says that 7-11 makes the best coffee in the whole US. Does he actually believe that 7-11 makes the best coffee? Chances are he never really gave it much thought, he just knows that that is what he should say as CEO to promote his company. Similarly MTG actually think that Babbit was pushed? She probably doesn’t know or care, since that isn’t really relevant to what she should say in order to promote MAGA.
This is what I was getting at because of how often I see folks (not singling you out here) getting the concept of protected class wrong, it’s become a pet peeve of mine.
Using your example.
The protected class is race. Not a specific race, the very concept of race is the protected class.
US federal law protects individuals from discrimination or harassment based on the following nine protected classes: sex (including sexual orientation and gender identity), race/color, age, disability, national origin, religion/creed, or genetic information (added in 2008). Because McIntyre has a race he is, by default, part of that protected class. And because McIntyre has a sex/sexual orientation/gender identity, race/color, age, disability, national origin, religion/creed, etc. he also belongs to all of those protected classes too.
I’ll say it: Marjorie Taylor Greene isn’t stupid. She’s patriotic. She’ll do and say whatever her national leader, Vladimir Putin, tells her to. She knows it’s all false, but doesn’t care, because she has a job to do.
I’m still hoping we’ll learn that this arrogant action by Mace won’t be a freebie for her (much less an occasion to fund-raise). The Hill has:
The quoted witness is Elliott Hinkle. The police report, which uses Mace’s version, talks about McIntyre holding Mace’s hand with both of his and basically imprisoning her for several seconds while pumping her arm “aggressively.”
Maybe no one had their phone out. But there had to have been several people watching this, and not all of them work for Mace.
More than useful since the idea of protected class constantly gets weaponized.
Everyone should remember the claim that recognition of new protected classes was “special rights” for Blacks/women/LGBT/etc. when in fact the classes were race/gender/orientation/etc. which includes everyone.
The “special right” was getting treated the same as everyone else.
I think probably part of the problem is that according to this definition, protected “class” is a bit of a misnomer. When I think of a class I think of a group of things. So white is a class of people, black is a class of people, but “race” isn’t really a class of people. Perhaps it would be better to think of it as protected distinctions. But alas its too late to change the verbiage.
