I don’t know- has Lindsay Graham spent any time alone with him lately?

That would be an ass hickey.
Are there any stats as to what percentage of debts are paid by any estate holdings after a person dies, as opposed to debts never paid out because the money just isn’t there? If I owe money when I die, and I don’t leave an estate outside of personal effects that are exempt, how is the debt paid (or is it)?

It isn’t.

I’m glad to learn most of these laws are not enforced. So far as I’m concerned, they shouldn’t even be on the books.
For sure they should not.
Damn. Woke up not seeing the headline I was hoping for.

It seems to me that, after a person dies, whatever they owned instantly becomes the property of the heirs. The problem of probate isn’t that the property isn’t owned; it’s that the courts don’t know who owns it.
It’s like, if I find a dropped wallet lying on the sidewalk, someone owns it. I just don’t know who that is, right away.
If you want to look at it that way, which makes some sense but IMO isn’t really technically legally valid, then you need a little more nuanced treatment. Which gets to this:
The property is owned by the creditors, the tax authorities, and the heirs , in that order The problem of probate isn’t that the property isn’t owned; it’s that the courts don’t know who owns it. Yet.
Can’t we spin this talk of estates to its own thread? I want more Rudi death watch.
