From East Texas comes one of themore spectacularly stupid Republican ideas:

State Rep. David Simpson, R-Longview, called on Gov. Greg Abbott to immediately call a special session of the 84th Legislature to end Texas’ involvement in the marriage process and put the process in the hands of individual religious denominations.

Simpson said the best way to protect marriage is to divorce it from government. He asked the governor to recall the legislature so that legislation may be immediately considered to remove state and local officials from the process of issuing marriage licenses. In its place, the process of issuing a certificate of marriage would be performed by any willing clergy member consistent with their conscience and in respect for culture and heritage.

For those who do not wish to have a religious ceremony, any authorized notary may approve a certificate.

I suppose he does not realize that many gay Texans have already gotten married. And that the State’s higher officials haven’t opposed gay marriage meaningfully since Friday. They’ve made statements & encouraged clerks who are too religious to do their jobs to lawyer up.

None of which matters. He’s running for State Senator & this is free publicity…

In Scalia’s butthurt Gay Marriage dissent he points out that 8 of the 9 justices are from either of the two coasts, 4 are from New York alone and the faiths of the justices are not representative of the nation as a whole. Supreme Court Justices are not required nor intended to be representative of the nation as a whole, but since Scalia is concerned about equitable representation perhaps he could start with concern that the 22 female GOP representatives in the House represent 8.9% of that parties members.

If Scalia is so concerned about the lack of diversity on the Court, he should act immediately to alleviate it… by resigning.

It looks like announcing his (imaginary) bid for the presidency wasn’t such a great idea: NBC has fired Donald Trump. Specifically, they fired him because of remarks he made regarding Mexican immigrants during his announcement of his candidacy.

Actually, there are lots of cases that aren’t about those particular ideological differences, and don’t split quite that way.

Cite? Obviously some decisions are 7-2, etc. but on the close votes the correlations are rather consistent and strong.

Some years ago at SDMB, I posted a statistical summary of all 5-4 votes over a period of a decade or so, demonstrating the correlations. Do you have new statistics showing the opposite, or was yours just a fanciful post?

And…how does this contradict what I have said? Is it your contention that Anthony Kennedy is always in the majority and always steering the majority? If not, then we really don’t have a one-justice Court.

When I saw that, I figured it had to be a prelude to a retirement announcement. He’s one of those New York Catholics he was complaining about, so surely he’s planning to do the right thing and make way for some diversity.

I think he was saying California doesn’t count as ‘western’, as in bumfucked flyover country western. Which yeah, ok, but what percentage of our population would count as western in Scalia’s eyes? 10%?

A poster earlier got it right, Tony is truly astonished into denial that his opinion isn’t shared by not only the majority of Justices but the majority of Americans.

I read an article earlier today describing what the author thought Traditional Marriage really meant to conservatives since they disregard even their own arguments for it when pressed (old, infertile and unwilling are allowed to get married so it isn’t procreation, divorce is legal along with sole custody so it isn’t ‘every child should have a mother and father’, etc.). She laid out the case that traditional marriage meant female subservience, and what gay marriage really allows is no gender roles in marriage whatsoever. That is really the crux of their beef, and it’s why straight Christians have a problem with what nonstraight nonChristians do.

So you’re modifying your original claim by replacing “lots of” with “more than zero.” Got it.

BTW, O’Connor was still on the Court for 48 of those cases; like Kennedy she often joined the liberals. After her replacement with Alito, the 4-4 division became even starker.

While it’s true that Kennedy joined the majority in “only” 90 of the 113 cases, the odds of this happening if one assumes votes are uncorrelated, are more than 14 million -to- one against.

And, in 52 of the 113 5-4 decisions, the compositiions of the 5 and the 4 were strictly identical. Again assuming no correlation that chance of that is 500 trillion trillion trillion trillion trillion trillion -to- one against. That’s “Trillion Trillion Trillion Trillion Trillion Trillion” with six T’s. (Or if you prefer to work with smaller numbers, 500 billion billion billion billion billion billion billion billion -to- one against. That’s “Billion Billion Billion Billion Billion Billion Billion Billion” with eight B’s.)
