Every time a Republican comes out rabidly against gay rights or SSM, they get caught having gay sex in a bathroom.

A proper conservative solution would be to tie funding for rape investigation to the same budget as rape kits. And then cut that part of the budget.
That’s not so much an “it depends”, than a “there’s a 1 in a million situation where that could be rape”. People lie to get sex, both women and men. Situations where people pretend to be someone the person is already in a relationship with are seen more in movies and literature than in real life.
She also argued that if a woman is not sober and gives consent, it’s really a “no”. That’s where we get into really dangerous territory, when yes actually can mean no.
Not to mention that people who have sex with drunk women are often drunk themselves. Could charges be filed mutually or is it just the fault of the one with the penis?
Um… yes ? It’s not exactly a novel and puzzling concept. If the lady’s blitzed, the right thing to do is to call her a cab or escort her home, get her number, then go away. If she’s into you, you’ll get to the fun part later anyway. If she’s not, well, first you’ll just not have had sex once, which is hardly a tragic catastophe; second we get an inkling of how that could be rape to take advantage of her altered state, neh ?
I agree with the morals of it. I just don’t think it’s rape unless she’s so blitzed she’s insensate. If she’s saying yes or downright encouraging you to get it on with her, that’s not rape. That’s consensual.
While the conservative push back over expanding the definition of rape has been argued in a clumsy way, I do agree in general that criminalizing behavior done by literally millions of men for as long as men have been around, while also roping in quite a large number of women as well who engage in such behavior is not a good idea. That’s why going from “no means no” to requiring affirmative consent is probably going to have unintended consequences. Starting with a lot of female rapists on college campuses.
