You are entirely correct. For that to be the case, it would have to be filed.

There’s already a constitutional remedy for that situation, and it doesn’t involve Congress suing the President in federal court. Impeachment is a political solution for a political problem. If Boehner can’t convince enough of Congress (in both houses) to impeach the President, then apparently Obama’s supposed crimes aren’t really serious enough to warrant a response.

Obama’s “crime” is being black.

Impeachment is an extreme act only to be used in cases of extreme Presidential lawlessness.

A better approach than either suing or impeachment would be to simply expand the jurisdiction of the Supreme Court by statute, telling them that they need to adjudicate these legislative-executive disputes even if no one has standing. SCOTUS overturned Trumans’ takeover of the steel companies, so they are willing to go here when they believe they have a political leg to stand on. Congress should give them that leg. SCOTUS should decide these cases simply by having a certain number of Congressmen ask them to.

SCOTUS refuses to get into the middle of battles between the other branches. They might even decide that such a change to their remit would be unconstitutional.
