I pictured the scenario: Angel One has to set down shortly after takeoff in Greensboro NC due to the plane having “technical issues”. They bring in some technicians to working on the vexation, which takes them 2 hours to fix. At that point, they tell him that it is 12:30, and they have orders to return to Washington, so get off the plane – there will be an Amtrak on Friday, that will take you to Raleigh where you can get a train to West Palm Beach that will get you there on Saturday afternoon.

Um, if we had declared a winner on November 4th, wouldn’t that have been Trump? I’m pretty sure he was ahead in PA, GA, and AZ at that time…
And, BTW - there are perfectly good reasons why we haven’t changed the inauguration date. OK, let’s ignore Trump’s infantile actions. It took almost a week just to count all of the results. In 2000, we needed time for actual disputes, court cases, etc. IF THERE ARE TRUE LEGAL QUESTIONS, this gives us time to resolve them. IN NORMAL TIMES, there are necessary transfer actions - the President Elect needs to learn some things before assuming power; he has to get teams in place, etc. Maybe we need some limitations on Presidential power during the transition period, but we can’t just throw out the entire system because the American public made one bad (admittedly EXTREMELY BAD) decision in 2016.

One thing that supporters of the insurrection fail to understand is that if they achieved their goal and got Trump named president, again they would lose all their rights. If I were in law enforcement and the Trump coup succeeded the first thing I would do is start confiscating the weapons of anyone involved.

Why not move the election, which doesn’t require an amendment? First weekend in December would work (two days and most folks don’t work weekends and even fewer work both weekend days (as opposed to Tuesdays)). Some logistic problems since I think churches are fairly popular as voting locations, but maybe we could move back to schools since they aren’t in session on weekends.
Leaves one and a half months for counting and transitioning.

Because the Rs forced several states to refrain from counting any votes before the polls closed. I would prefer an election where the voting takes several weeks and the early votes are counted as they are received and running totals reported weekly.
That’ll be the most blood-boiling part of the whole thing:
- Trump makes choices that lead to more death, illness, and economic suffering, and entrenches those problems in ways that are much harder to combat than the original outbreak.
- Biden enacts policies that attempt to slow/reverse a situation made drastically worse because of Trump’s choices.
- A Republican gets sick, dies, or loses their business as a result of COVID after Jan 20th
- Republican outcry: “Joe Biden is worse on COVID that Trump was!!!”

Obviously I’m talking about as soon as the outcome is known. And the fact that this wasn’t the case on Nov 4th just highlights other defects in our system. To some extent poor and patchwork technology, but principally deliberate Republican ploys to prevent timely counting of votes.
But these are not perfectly good reasons. These kind of protracted legal challenges just do not happen in most democracies. If we had an independent electoral commission and sensibly run elections that weren’t in the hands of partisan state operatives the question of legal challenges would be largely moot.
An extended lame duck period is a terrible idea for precisely the reasons we have just seen. When the defeated incumbent is a bad actor, it greatly increases the opportunity to execute a coup.
The whole idea that everything’s fine so long as everyone is behaving honorably and according to norms is just not a good argument. A good constitution is designed to be robust to bad actors. We are seeing how fragile our constitution really is.
As pessimistic as I normally am, I am cautiously optimistic that Biden knows how to deal with this: like his democratic predecessor, he will keep his head down, ignore the drama, and go to work. He knows a lot of Republicans will blame him no matter what he does, but I think if he can focus on being effective and convincing independents that he’s trying to be effective, he can change some minds, even if he can’t completely convert hearts.
