I’m sure that’s part of it. But he was blabbing on last night about how he’s willing to go to prison in support of some principle. I can’t for the life of me figure out what that would be. The ability to ignore subpoenas is not a great principle to fight and die for.
ETA: and he was confident that the Supreme Court would vindicate his right to ignore lawful subpoenas. Even the current Court won’t give him that. I think he perhaps he loses 8-1 or 7-2, but probably 9-0
I think he must mean the assumed by him and his kind “principle” that certain people are above the law as it applies to others. As far as I’m concerned, he is more than welcome to go to prison in support of that.
A judge cannot punish a defendant simply for exercising his right to a jury trial, of course. But in discussing a proposed plea agreement, the judge can certainly explain that the defendant is facing less prison exposure if he takes the prosecution’s deal than if he goes to trial and is convicted of more, or all, charges.
