However, and I’ve said this repeatedly throughout the discussion, I don’t believe it can come into play in this election, because the rules can’t be changed retroactively and I don’t believe in the end it’s going to be a 270 EV election. I think blatantly going against the will of the people in a decisive election brings a significant amount of risk – even for this newly-constituted SCOTUS.
You are correct that it’s a whole new ball game with the newly-constituted Supreme Court, and they will advance their objectives to rule by minority whenever they think they can get away with it.
I do think it is also significant that Republicans are backing away from Trump and do not appear to have an appetite for pursuing this path of madness. For now.
