From Politico:

Brann was appointed by President Barack Obama, but is regarded as a conservative judge and an atypical Obama nominee. Brann, who was selected by Sen. Pat Toomey (R-Pa.), served as a regional Republican Party chairman in Pennsylvania for about a decade before being nominated to the federal bench.

I’ve also read that he’s a member of the Federalist Society, so, yeah, I’d guess he’s pretty conservative.
Not that various parts of the far-right press appear to have noticed that fact…

Huh. Speaking of Toomey, this just showed up on my twitter feed:

Sen. Pat Toomey (R-PA): “President Trump has exhausted all plausible legal options to challenge the result of the presidential race in Pennsylvania. … I congratulate President-elect Biden and Vice President-elect Kamala Harris on their victory.”

So … according to the article, Rudy and the Keystone Kounsellors will appeal toot sweet to the Third Circuit (presumably with a request to order a stay of the certification). Especially given the tone of the ruling, does the court have to accept the appeal? Or can they say, “We think your appeal is pig doots* and consign it to the dumper?” Also, it infers that Kathy Boockvar (PA SoS) plans to issue her certification on Monday, shortly after the deadline for counties to submit theirs; if she does so before any stay order, does that render the appeal moot?

Maybe my lawyer friend Karen will get back to me tonight, but I am pretty sure a court only has to take up an appeal if they want to, if there is a valid reason to do so

Yeah, I’m very skeptical that they’ll get any traction in the Supreme Court. I know judges can’t be impartial on all issues but this case is so obviously corrupt and undemocratic that I would be surprised if any Supreme Court Justice took these arguments seriously.

I won’t be surprised when Kavanaugh treats them seriously. That guy’s a fucking joke.

I can’t wait to see the look on trump’s face when Barrett tells him to pack his bags.

It’s very generous of Toomey to imply that the legal options he’s chosen so far were plausible.

Matthew W Brann is a republican Republican judge appointed by Obama. Take a minute and soak that in as it is so satisfying.

That has got to be one of my favorite pics of him. Number 1 on my list was him tripping over his bottom lip while stomping out of the interview, but this one is right up there in the top 10.

In the mail today, I received a newspaper. An actual, full-sized newspaper. I forget the name of it, but the headline screamed out the news that the election was far from decided. Other articles told of various “righteous” lawsuits in this or that state. I tossed it in the trash. it was addressed to “Current Resident,” so I suspect this is being mailed out to a lot of people.
