Election Day [Week][Month[s]] [Year] 2020 follow-along thread

Suffice it to say that I read that article with an enormous amount of skepticism. There may be statements from a couple Republican greybeards who don’t have to face the voters again, or a couple of Senators who still want to maintain some semblance of credibility on governing. But they’re sure as shit not going to say that Donald Trump “lost fair and square.” At most you’ll get some non-specific mumbling about “an imperfect process” but a need to “move on.”

Makes for some fun reading. The Pennsylvania one is particularly good (of what I have read so far). I laughed out-loud at this line where they quote from the Texas complaint: “…Democrat [sic] voters…” It is about time someone points out that using “Democrat” as an adjective is not some sort of brilliant insult but just makes one seem like they are not educated enough to understand basic grammar. It is quite pathetic how using “Democrat” in this way has become the sort of must-do among Republicans.

I thought of it later but couldn’t remember at the time and way too lazy to look it up. I stand by my characterization of these lawsuits, however!

I keep wishing some of these lawyers would get sanctioned because it’s getting ridiculous. Can’t prove they’re purposely lying, yada yada whatever. At this point at the very least they’re filing frivolous lawsuits. Not a lawyer, just wondering how long the Kraken-Hydra can keep this BS going if not legally forced to stop. Next four years?

Trump has been urging lower court judges to rule quickly in the cases so he can file appeals before the Electoral College meets on Monday and casts Wisconsin’s 10 votes for Biden.

I’m surprised none of the judges are just slow walking this until next week. Why do they indulge the Trumpers by ruling quickly? All they have to do is take it under advisement for a few days and the clock runs out. “Poor planning on your part does not create an emergency on mine.”

IANAL, but I believe a request for expedited ruling just requires you to show you will be harmed if the ruling is not made quickly. Especially for a dismissal where there is no fact-finding on hearings there is no reason not to rule quickly. I could see why, if there truly were a case to rule on, it would be injurious to the Trump campaign to wait until after the EC voted.

Sure, they have every right to ask, and the court has discretion to act quickly. The court, however, is not required to. Obviously, if they sat on an expedited request for weeks the parties would got the next higher court and beg for intervention. But no one is going to get very far complaining the judge took a few days to research these important questions. And a few days, at this point, is all that is needed to screw things up.

ETA: The courts are being very accommodating to the Trump campaigns procedural requests. That’s probably a good thing, but it should be noted. They don’t have to be.

I think they probably recognize that the cases aren’t going to go any further in higher courts. If they slow-walk it, it leaves open the argument that the case had merits, there just wasn’t time. It’s better to slam the door on these things by rejecting them quickly and hopefully cut down on this crap in the future.

Since they’re ruling against the Trump campaign, I don’t see that as indulging them.

Saying clearly “you have no case” seems to me far preferable to ‘um, maybe you might have a case, if we had long enough to think about it.’

My guess is that the senate will hold hearings on “the stolen election” in perpetuity…

More and more, it’s seeming like “Release the Krackpots!”

It seems to me that there will be a ruling today. After all, Monday is Electors Day. I can’t see them allowing the electors in the four states to cast their ballots and then force the states to take them back. This should be a quick ruling against the plaintiffs. If on the other hand it goes the other way, then democracy is dead. Tear down the monuments, rip up the Constitution, we’ve lost everything.
