A Massachusetts district court judge dismissed three counts levied against the Florida-based company but ruled Vertol must face the eight remaining counts. The judge dismissed the state actors, including DeSantis, as defendants in this case, after determining the court lacked jurisdiction.
The judge also added:
“Treating vulnerable individuals like Plaintiffs in this way, as alleged and accepted as true for purposes of the motion to dismiss, … is nothing short of extreme, outrageous, uncivilized, intolerable, and stunning.”

Apparently the counts against DeSantis were dismissed due to lack of jurisdiction.
But can charter flight company Vertol Systems Co. successfully sue DeSantis for hiring them for an illegal act? For a contracting them for a flight which subsequently led to financial losses, due to the illegality of the act?
IANAL, but ISTM they went into the deal with eyes open and could have told DeSantis to fuck off. “We didn’t know it would be illegal” sounds like lousy grounds for a lawsuit.
Against a normal defendant perhaps, but against the sitting governor of a state? There would seem to be reasonable grounds for a company to make the assumption that they were conducting legal business if the governor hires you.
