Last year they tied funding for the courts to a number of policy changes that affect how the courts work (removing the Kansas Supreme Court’s authority to appoint chief justices and make budget allocations). A lawsuit has been filed alleging this is un-state-Constitutional, and that lawsuit is still pending[sup]1[/sup]. And this year, the state legislature is once more tying funding for the judiciary to their possibly un-Constitutional laws on selecting state judges. This places the Shawnee District Court in the enviable position of declaring the law constitutional and retaining funding, or declaring it un-constitutional and losing all funding for the judiciary.
[sup]1[/sup]The Kansas State Constitution says “The supreme court shall have general administrative authority over all the courts in this state.”

4 of the justices (out of 7) happen to have been appointed by a Democratic governor. One assumes this has to do with that.
I don’t know. The republicans are saying it’s to create more local control over courts. The democrats are saying it’s an attempt to force the courts to do what the (vast majority) republicans in the state legislature want, and there are hints in the articles I’ve seen that it’s payback for the courts forcing the legislature to spend more money on public education which, as we all know, is anathema to many in the republican party.

I’m thinking that the “intellectual arrogance” thing is the new talking point, since the “I’m not a scientist” thing was roundly met with derision. I suspect that this one will meet with a similar lack of success.
